Banjarmasin, South Kalimantan (Antaranews) - Chairman of Commission I on law and government of South Kalimantan DPRD H Achmad Bisung argued, the grant of main terminal on Jalan A Yani Km6 Banjarmasin is the authority of the local governor.
"It must not get the approval of the provincial assembly first," he said here on Wednesday.
The senior Democratic Party politician's opinion based on Central Government Regulation (PP) No. 6 year 2006 and the Regulation of the Interior Minister (Permendagri) No.17 year 2007.
"According to both the regulation ( PP 6/2006 & Permendagri 17/2007 ), as far as for the public interest, the governor can grant local assets owned by the provincial government (Pemprov), not necessarily with the approval of the local assembly," he said.
About the existence of the building that is intended as Banjarmasin Trade Center (BTC) at the terminal area, according to him, it is the authority of local municipalities, when the grant was made.
"But we hope, it remains as the designation terminal in order for the better structuring of public passenger transport fleet or at least not chaotic," Bisung said.
The problem of main terminal was sticking to the surface, when the local municipal government (in the early 2000s )
claims to be the owner. Then it do a swap with investors, who want to "turn" it into BTC terminal region, and promised a replacement terminal in the South Ring Road area of Basirih, Banjarmasin.
But investors were building BTC first in the area of ​​the main terminal, while the promised terminal replacement in
Basirih, until now never exist.
The policy then got protest from Governor of South Kalimantan (HM Sjachriel Darham), because it was without the permission of Pemprov as the owner. In the 1970s, Pemprov just handed the management of the main terminal to the Banjarmasin City Government, so it is not authorized to change the ownership status. *** ***
