Jakarta High Administrative Court (PTTUN) rejected an appeal submitted by the Indonesian Forum for the Environment (Walhi).


Walhi received a notification of the appeal refusal on Wednesday (3/20). Rejection of the appeal was decided by PTTUN on Thursday (3/14).

The appeal was filed after the first court of the PTUN decided NO or Niet Ontvankelijke Verklaard (unacceptable) against Walhi's claim.

Walhi filed a lawsuit and appealed against the decision issued by the Ministry of Energy and Mineral Resources in Jakarta on December 4, 2017 (SK No. 441.K/30/DJB/2017) regarding adjusting the stage of PKP2B activities to the production operation stage to PT Mantimin Coal Mining (MCM). The permit covers 3 districts (Tabalong, Balangan, and Central Hulu Sungai).

The total coal mining permit is 1,398.78 hectares and is in secondary forest, settlements of 51.60 hectares, rice fields of 147.40 hectares, and rivers of 63.12 hectares. It is on the stretch of the Meratus Mountains. In South Kalimantan itself, MCM controls 5,900 hectares of land.

Especially on HST, permits are not far from the Batang Alai Dam and will eliminate forests and limestone mountains in Nateh, eliminating Batu Tangga Village and other villages.

Walhi's claim process in the court took place since February 28, 2018. Walhi South Kalimantan and the Earth Rescue Movement Murakata (Gembuk) along with the HST regency government filed a lawsuit against the permit at the Administrative Court in Jakarta. Then on April 4, 2018 to October 22, 2018, a hearing was held.

Including the on-site trial (in Nateh Village in HST) on July 2018. Strangely, on October 22, 2018, the Administrative Court issued a decree stating that the lawsuit against the coal mining permit could not be accepted due to an incorrect address.

Then on November 2, 2018 Walhi appealed. For four months the appeals process took place. On March 14, 2019 PTTUN Jakarta upheld the PTUN ruling by rejecting an appeal that Walhi submitted.

Responding to the rejection of the appeal, Walhi's Executive Director of South Kalimantan Kisworo Dwi Cahyono said Tuesday (2/4) his party had filed an appeal.

"The two decisions were very disappointing. Walhi filed an appeal today. Walhi asked the South Kalimantan people to continue to close the ranks by supporting the #SaveMeratus movement. The rejection of the appeal made Meratus even more in danger," he said.
