Banjarmasin, S Kalimantan (AntaranewsKalsel) - The Banjarmasin Civil Court of Justice (PTUN) granted PT Sebuku's three lawsuits against South Kalimantan Governor in a hearing on Thursday.
Chief Judge Luthfie Ardhian, in a trial lawsuit of PT Sebuku Sejaka Coal, said that no people aspiration letter was issued by the Regent of Kotabaru on December 29, 2004 in the form of a ban on coal mining activities in Pulau Laut. In addition, the revocation of environmental permits is not or not the same as the revocation of production business license.
The two other lawsuits, proposed by PT Sebuku Tanjung Coal, chaired by the presiding judge Retno Widowati, and proposed by PT Sebuku Batubai Coal led by chief judge Dafrian, also won the plaintiff.
"We are grateful for this decision even though it is not final yet, because the defendant's legal counsel has said to file an appeal," lawyer PT Sebuku Yusril Ihza Mahendra remarked here.
Yusril also appreciated the judges of PTUN Banjarmasin who decided on the basis of his judgment by looking at the facts of the trial and the arguments and statements of expert witnesses, even under the pressure and extraordinary opinion raising.
Meanwhile, the defendant's lawyer Dr Andi Muhammad Asrun said he would make a legal action by appealing as soon as possible.
He considered that many of the arguments he proposed in the trial were not taken as a matter of consideration, so the judges' ruling was considered unfair.
