Banjarmasin, S Kalimantan (AntaranewsKalsel) - An owner of land with land ownership certificate (SHM) No. 5048 on behalf of Iwan Sardjono filed a lawsuit to the Banjarbaru District Court with the defendant the state airport operator PT Angkasa Pura I.


"We filed the lawsuit on February 27, 2018 to the Banjarbaru District Court," said Dr. H Fauzan Ramon, SH, MH as the plaintiff's attorney on Sunday.

He said in addition to PT AP I, his side also sued three other parties, namely Yusuf Maryoto, Banjarbaru Land Procurement Committee (TP2T) team, and Head of Banjarbaru Land Agency (BPN).

Fauzan asserted that the lawsuit was filed because until now there is no goodwill from the defendants to fulfill their obligation to provide compensation for the land in Tegal Arum Jalan Sempati or formerly East Landasan Ulin Village but now the Urban Village of Syamsudin Noor, Banjarbaru, an area of 12,105 square meters.

"Since April 2017, the plaintiff's land has been unilaterally controlled by PT AP I by leveling the land using bulldozers, the land has also been fenced without the knowledge and permission of the legitimate owner Iwan Sardjono," said the famous lawyer.

Fauzan said that the basis of PT AP executed the land was it is included in the land acquisition map for the expansion project of Syamsudin Noor Airport and had compensated the land through TP2T.

Overall, Fauzan said, there is no confirmation and notification to his client regarding the provision of compensation.

"Our client was surprised by Angkasa Pura's confirmation that since the purchase of land in 2004, the plaintiff has never sold it to anyone, except as collateral to PT Bank Internasional Indonesia Tbk (Maybank) since May 08, 2014," he said.

For that, Fauzan said, the plaintiff filed a lawsuit to obtain his rights over the ownership of the land that had been seized by the defendant (PT AP).

He also requested the court to punish the defendants jointly to pay rent for the object of dispute for 6 years (starting during the year 2012 to 2018) amounting to Rp300.000.000.

He also asks the court to punish the defendants to pay immaterial damages against the plaintiffs amounting to Rp1,200,000,000,000 and to pay compensation for the project amounting to Rp60,525,000,000.
